Five years after the European Company Statute (SE) entered
into force, the European Commission has launched a public
consultation with a view to making it work better.

While the SE (Societas Europeae) has proved popular in some
Member States, in others it has not taken off at all. A 2009
study provides some clues: set-up costs, complexity and
uncertainty, as well as employee involvement issues have
largely offset the attractions of moving a registered
office and promoting a European image.

Commissioner Michel Barnier, however, says the SE can
“substantially reduce costs for businesses operating across
borders”, and is encouraging all interested parties to give
their views. Responses by 23 May.
